Statement on Qualified Immunity Bill (2024)

APANJ Opposes Bill Eliminating Qualified Immunity for APs/DAGs

As many of you know, Senate Bill S2144 was introduced on January 9, 2024.  The Bill, sponsored by Senator Joseph P. Cryan and Co-Sponsored by Senator Robert W. Singer, “Eliminates immunity for State, county and municipal prosecutors who fail to disclose exculpatory evidence in criminal cases.”
 
The APANJ Opposes Senate Bill 2144.
 
Please know that the APANJ has remained steadfast in our mission to advance the interests of assistant prosecutors.  Our opposition to this Bill is not different.

We have been tracking this Bill and voiced our opposition to State officials.  There are a litany of problems with the proposed legislation.  Above all, it would endanger the public by prompting an exodus of experienced and earnest line prosecutors choosing to leave the profession rather than jeopardizing their livelihood.
 
Bill S2144 is an affront to the hard-working, well-meaning line prosecutors who on a daily basis make sacrifices of their time, economic prosperity and emotional and mental well-being in the furtherance of the welfare of the citizens of New Jersey. We have all undertaken oaths to uphold the Constitution; we do not need to live in fear to ensure that its principles are honored.    
 
Currently, the Bill has been referred to the Senate Judiciary Committee and lacks an Assembly counterpart. The APANJ will continue to keep you informed.
